PROJECT MOOD — TERMS & CONDITIONS
DEFINITIONS
"Studio" means Project Mood Pty Ltd and its directors, employees, staff, and independent contractors operating at 95 Coventry St, Southbank VIC 3006.
"You", "your", "Member", "Client", and "Guest" means the person accessing, booking, or purchasing services from Project Mood.
"Recreational Activities" means all activities available at the Studio including Reformer Pilates, Strength & Conditioning, Breathwork, Aufguss, Open Gym, and Bathhouse (sauna, steam room, cold plunge, and magnesium pool).
"Injury" means both physical and mental injury, including the aggravation, acceleration or recurrence of an injury — including overheating, heatstroke, cardiovascular stress or failure, slipping, drowning, loss of or complications to pregnancy, and death.
"Illness" means any illness or disease, whether physical or mental.
"In Writing" means delivered in person at the Studio or sent by email to hello@projectmood.com.au.
CLIENT OBLIGATIONS
These Terms are a legally binding obligation for which you are financially responsible. By entering the Studio or purchasing any service, you agree to:
Not conduct any commercial or business activity within the Studio, including acting as a personal trainer or instructor for any other person.
Notify Project Mood In Writing of any changes to your contact information.
Comply with all Studio rules, safety instructions, and directions from staff at all times.
Treat all staff, members, and guests with respect.
CONDITIONS OF ENTRY
Entry is at the sole discretion of Project Mood staff. The following apply to all guests and members:
Swimwear must be worn at all times in the Bathhouse.
The following are not permitted on premises: food or beverages other than water, alcohol or drugs of any kind, glassware or sharp objects, animals except guide dogs, and recording devices in any change room or bathroom.
Smoking and vaping are not permitted anywhere on Studio premises.
Project Mood reserves the right to refuse entry or remove any guest for offensive or intimidating behaviour, intoxication, nudity, failure to follow safety instructions, or failure to comply with these Terms. No refund will be issued in these circumstances.
Lockers are available for use during your visit. Project Mood accepts no liability for any loss, damage, or theft of personal items.
Vehicles are parked at your own risk.
CCTV cameras operate throughout all areas of the Studio other than private change rooms and toilet facilities. By entering the Studio you consent to being filmed for security and safety purposes.
Photographs and video taken at the Studio are for personal use only. Recording devices are not permitted in any change room or bathroom.
Project Mood reserves the right to inspect bags for security purposes at any time.
GUEST ACCESS AND LIABILITY
Where a guest attends the Studio through a member booking or staff guest credit and has not created their own Project Mood account or completed a personal waiver, that guest enters the Studio entirely at their own risk. By entering the Studio, unconverted guests acknowledge that they have read and agree to these Terms and the Conditions of Entry, assume full responsibility for any injury, illness, loss, or damage suffered during their visit to the extent permitted by law, and release Project Mood from any liability arising from their participation in any Recreational Activity or use of any Studio facility. The member who facilitated access accepts responsibility for ensuring the guest is aware of and agrees to these Terms prior to entry. Project Mood strongly recommends all guests create a personal account and complete a waiver prior to their visit. – make it manadatory
MEMBERSHIPS
Memberships are valid for one person only and cannot be shared, gifted, or transferred. A valid credit card must be on file at all times. All prices are in AUD inclusive of GST. All refunds are by credit to the card on file or on account balance — there are no cash refunds. Project Mood is not responsible for bank fees resulting from automatic charges.
What's included. One credit equals one session, redeemable for Reformer Pilates, Strength & Conditioning, Breathwork, Aufguss, Bathhouse, or Open Gym. Credits do not roll over — unused sessions expire at the end of each 7-day billing cycle. Limited use memberships (e.g. 2x Weekly) reset each week and unused sessions do not carry forward under any circumstances. Towel hire is included for all class memberships. The Bathhouse & Gym Access membership includes unlimited bathhouse access, gym access, and towel hire but does not include class access.
Billing. Your first cycle is charged at the time of purchase. Your membership activates upon your first reservation and renews automatically every 7 days. If a payment fails, you will be notified and a second attempt will be made the same day. If unresolved within 7 days, your membership will be frozen until settled. Late fees may apply to outstanding balances. You must immediately pay any amount owing upon notification of a failed payment. Any unpaid balance remains due upon cancellation.
Minimum term. All memberships carry a minimum commitment term of 3 or 6 months depending on the plan. Any freeze or hold period does not count toward the minimum term. At the end of the minimum term, your membership renews automatically until you cancel In Writing.
Cancellations. To cancel, email hello@projectmood.com.au at least 7 days before your next billing date. Cancellations cannot be accepted verbally. Written confirmation will be provided once processed. Where you cancel before completing your minimum term, a break fee of 50% of your weekly rate multiplied by the remaining weeks applies. No break fee applies where cancellation is due to medical incapacity, relocation more than 20km from the Studio, or genuine financial hardship — supporting documentation required in all cases. All refunds are by credit to the card on file.
Termination due to injury or illness. In the case of a long-term or permanent injury or illness that prevents you from using our services, immediate membership termination will be permitted without a break fee. Termination takes effect from the date Project Mood receives written confirmation from a registered medical doctor sent to hello@projectmood.com.au.
Freezes. Memberships can be frozen upon written request to hello@projectmood.com.au. Written notice must be received at least 7 days before your next billing cycle. Freeze periods have a minimum duration of 1 week. Should you wish to continue the freeze beyond 8 weeks, this is available at a processing charge of $10 per week to hold your membership rate. Memberships cannot be cancelled while frozen.
Upgrades and downgrades. You can change your membership tier at any time by contacting hello@projectmood.com.au. Changes take effect from your next billing cycle.
Pricing. Membership prices are subject to change. You will be notified In Writing at least 4 weeks before any price increase takes effect. If you do not wish to continue under the new pricing, you may cancel In Writing within that 4-week window.
Introductory offers. Introductory offers are available to new clients only and can be used once. Project Mood reserves the right to decline repeat redemptions.
Discounts. Discount codes cannot be combined with other offers unless expressly stated. Project Mood reserves the right to withdraw any promotional offer at any time.
Special and collaborative memberships. Project Mood may offer special or collaborative memberships in partnership with external organisations. These are subject to specific eligibility requirements and conditions communicated at point of sale. All general membership terms apply except where expressly varied. Project Mood reserves the right to review, vary, or discontinue any collaborative arrangement at its discretion.
Studio termination. Project Mood may terminate a membership by written notice where a member fails to comply with these Terms and does not remedy the failure within a reasonable time. Outstanding fees for services already provided remain payable.
CREDIT PACKAGES & SINGLE SESSIONS
Credit packages and single sessions are valid for individual use and are non-transferable. Credits may be used to book sessions for guests, provided each guest has completed a Project Mood Guest Waiver and created a personal Project Mood account prior to their visit. All purchases are final. All refunds are by credit to the card on file — there are no cash refunds.
Activation and expiry. Credits activate on the date of your first attended session. The expiry period applicable to your package will be communicated at the point of sale and confirmed in your purchase receipt. Credits do not roll over or extend beyond the stated expiry date under any circumstances. A credit forfeited due to a late cancellation or no-show does not affect the expiry date.
Booking limits. Credit package holders may book for a maximum of 5 guests per session. Bookings for 6 or more people constitute a group booking and must be arranged by emailing hello@projectmood.com.au. Group bookings are subject to availability and separate pricing.
Guest requirements. It is the responsibility of the credit package holder to ensure all guests have completed a Guest Waiver and created a Project Mood account before arriving. Project Mood reserves the right to refuse entry to any guest who has not done so.
Payment. All purchases are made in full at the time of sale. Project Mood may terminate a credit pack for breach of these Terms, in which case unused credits are forfeited and non-refundable.
CLASS BOOKINGS & CANCELLATIONS
Classes must be pre-booked via the Project Mood website or app. Bookings open on a 7-day rolling schedule. Please arrive and check in at least 5 minutes before the class start time. Entry will not be permitted after a class has commenced.
Cancellation policy:
Early cancel (more than 6 hours before class): no fee, credit returned.
Late cancel (within 6 hours of class start): $10 fee, credit forfeited.
No-show: $15 fee, credit forfeited.
Cancellations must be made through the Online Booking System — phone and email cancellations are not accepted. Project Mood reserves the right to release your spot if you have not checked in within 5 minutes of the class start time.
Waitlist. If a class is full, join the waitlist. You will be added automatically if a spot opens, but not within the 6-hour cancellation window. Remove yourself from the waitlist if you can no longer attend to avoid a no-show fee.
Bathhouse late arrival. If you arrive more than 15 minutes late to a Bathhouse session, Project Mood may cancel your booking or deduct the time from your session without refund.
Third-party platforms. Bookings via ClassPass or Wellhub include class access only. Bathhouse access must be purchased separately at reception. The same cancellation and no-show policy applies.
STUDIO OPERATIONS & CLOSURES
Project Mood reserves the right to remove, discontinue, repair, or replace equipment, change instructors, or modify services at any time. None of these events affect your membership obligations or entitle you to a refund of unused credits, except where required by the ACL.
Planned closures. The Studio may close for up to 4 weeks per year at management's discretion for maintenance, repair, or operational purposes. Where possible, members will be given at least 7 days written notice prior to any planned closure. Temporary planned closures do not affect membership billing obligations or entitle members to a refund of unused credits, except where required by the ACL.
Unplanned closures. From time to time the Studio or specific facilities may need to close at short notice due to circumstances beyond our control, including equipment failure, building issues, utility outages, or safety requirements. Project Mood will make reasonable efforts to communicate any unplanned closure as quickly as possible. No compensation, credits, or refunds will be issued for unplanned closures except where required by the ACL.
Bathhouse availability. The Bathhouse may be subject to unplanned closures at short notice due to maintenance, equipment failure, water quality, or other operational requirements beyond our control. By purchasing a membership or credit package that includes Bathhouse access, you acknowledge and accept that the Bathhouse may not be available at all times and agree that Project Mood will not be liable to provide compensation, credits, or refunds for any session lost due to an unplanned Bathhouse closure. Where a planned Bathhouse closure is scheduled, we will provide notice where possible. This clause does not affect your rights under the Australian Consumer Law.
Facility modifications. The specific facilities, equipment, class types, and services available at the Studio may change from time to time at management's discretion. Project Mood does not guarantee the ongoing availability of any specific facility, class type, or instructor. Changes to the Studio's offering do not constitute grounds for membership cancellation or refund outside of the standard cancellation terms.
HEALTH, SAFETY & LIABILITY
Health declaration. By entering the Studio, you confirm you are in good physical health and are not aware of any medical condition, injury, or illness that would make participation in Recreational Activities unsafe. You agree to stop participating in any activity if you consider yourself at risk. Project Mood staff are not medical practitioners and nothing they communicate constitutes medical advice.
Pregnancy. Some or all Recreational Activities — including the Bathhouse and high-intensity classes — may not be suitable during pregnancy. You are responsible for obtaining medical clearance before participating. You must inform staff before any session. Certain activities have been designated as unsuitable for guests in their second or third trimester.
Bathhouse risks. Use of the Bathhouse involves specific risks. By entering, you acknowledge and accept the following known risks (this list is not exhaustive): slipping on wet surfaces; transitioning between extreme hot and cold temperatures; overheating and heatstroke; cardiovascular stress or failure; drowning; equipment malfunction; actions of other guests; and loss of or complications to pregnancy.
Assumption of risk. You acknowledge that Recreational Activities involve inherent risks including physical injury, illness, or death, and you voluntarily accept those risks.
Limitation of liability. You acknowledge that the Australian Consumer Law (ACL) contained in the Competition and Consumer Act 2010 (Cth) provides statutory guarantees requiring services to be rendered with due care and skill, be fit for purpose, and be supplied within a reasonable time. To the extent permitted by section 139A of the CCA, Project Mood excludes all liability for death or injury resulting from a failure to comply with any statutory guarantee in connection with the supply of Recreational Activities. This exclusion does not apply where you suffer significant personal injury caused by Project Mood's reckless conduct.
Under section 22 of the Australian Consumer Law and Fair Trading Act 2012 (Vic), by accepting these Terms you agree that your rights to sue Project Mood if you are killed or injured because services were not in accordance with these guarantees are excluded, restricted, or modified as set out here. This does not apply where your death or injury is due to gross negligence on the part of Project Mood.
Release and indemnity. To the extent permitted by law, you release, hold harmless, and discharge Project Mood, its owners, directors, officers, employees, agents, and related entities from any liability, claims, or causes of action arising from your entry into the Studio or participation in any Recreational Activity. You must indemnify Project Mood for any costs or losses arising from a breach of this release.
General exclusions. Nothing in these Terms excludes any right or remedy that cannot lawfully be excluded under the ACL or any other applicable law.
INTELLECTUAL PROPERTY
Project Mood, its logo, and all associated trademarks and trade names are and shall remain the exclusive property of Project Mood Pty Ltd. Any unauthorised use is prohibited. All content, programs, services, interface design, graphics, documentation, and resources provided by Project Mood are protected by copyright, trademark, and other applicable intellectual property laws of Australia. You may not sell, modify, reproduce, display, distribute, or otherwise use any Project Mood content or services for any commercial purpose without express written consent.
COMMUNICATIONS & PRIVACY
By purchasing a membership or providing your contact details, you consent to receiving transactional messages relating to your account. You may also receive promotional communications and can opt out at any time by clicking unsubscribe in any email or contacting hello@projectmood.com.au. Project Mood handles your personal information in accordance with its Privacy Statement available at projectmood.com.au.
BATHHOUSE POLICIES & CODE OF CONDUCT
These policies form part of the Project Mood Terms and Conditions and apply to all guests accessing the Bathhouse. By entering the Bathhouse you confirm you have read, understood, and agree to comply with these policies.
The following conditions apply to all Bathhouse guests:
All guests must shower before entering any Bathhouse facility.
Swimwear must be worn at all times. Nudity is not permitted.
Guests must be 16 years of age or older. Guests under 18 require prior written consent from a parent or guardian.
The Bathhouse is not suitable for guests who are pregnant, have cardiovascular conditions, high or low blood pressure, respiratory conditions, or any condition aggravated by extreme temperatures. If you are unsure, consult your doctor before entering.
Guests who appear intoxicated or under the influence of drugs or alcohol will be refused entry.
Guests with open wounds, skin infections, or communicable skin conditions are not permitted to use any shared Bathhouse facility. Project Mood reserves the right to refuse entry where a guest presents with a visible condition that may pose a risk to other guests.
Project Mood staff reserve the right to ask any guest to leave the Bathhouse at any time if they are behaving in a way that compromises the safety or comfort of others.
CODE OF CONDUCT
The Bathhouse is a quiet, low-stimulus environment. Keep noise to a minimum and be respectful of others.
Limit your time in the sauna and steam room to intervals recommended by staff or as displayed in the Bathhouse. Exit immediately if you feel dizzy, unwell, or uncomfortable.
Rinse off between facilities and move between hot and cold with care on wet surfaces.
Do not reserve space for extended periods. Towels and belongings should not be used to hold spots for others.
Glass, food, and beverages other than water are not permitted inside any Bathhouse facility.
Mobile phones and recording devices are not permitted inside the Bathhouse or change rooms.
Appropriate conduct is required at all times. Sexual acts, harassment, or intimidating behaviour will result in immediate removal and may result in permanent membership cancellation without refund.
CHANGES TO THESE TERMS
Project Mood reserves the right at its sole discretion to modify, add, or remove any terms or conditions at any time. Any changes take effect immediately upon being posted. We will make reasonable efforts to notify members of material changes by email. Your continued use of the Studio or its services following any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms from time to time.
GENERAL
Governing law. These Terms are governed by the laws of Victoria and the Commonwealth of Australia.
Severability. If any provision is found to be unlawful or unenforceable, it is severed and the remainder continues in full force.
Waiver. Failure by Project Mood to enforce any right at any time does not waive that right on future occasions.
Entire agreement. These Terms constitute the entire agreement between the parties and supersede all prior understandings. They may not be amended except in writing signed by both parties, except as set out in the Changes to These Terms clause above.
Assignment. Project Mood may assign these Terms to a third party by written notice. You may not assign any rights or obligations without Project Mood's prior written approval.
